What is the Driver’s License “10 Day Rule”?
Any time a person is arrested for DUI (driving under the influence) they will automatically have their driver’s license confiscated by law enforcement. It is always protocol to do this for the safety of the public and the driver of the motor vehicle. A person will then not be allowed to drive until they follow the driver’s license 10 day rule which states that a DHSMV (Department of Highway Safety and Motor Vehicles) Hearing must be scheduled within ten days of a DUI arrest.
The DHSMV Hearing is a very important part of maintaining your driving privileges and is completely separate from the actual criminal court case. It allows for the driver accused of DUI to contest the driver’s license suspension. Failure to schedule a DHSMV Hearing can and most likely will result in an automatic license suspension which can last anywhere from up to 1 year or more in the state of Florida.
The best chance that a person may have at fighting a license suspension, along with DUI charges, would be to hire an aggressive Stuart DUI attorney. - Was their BAC at or above 0.08%? (lower if 21 or under “or” commercial driver)
